TASChild and Youth Safe Organisations Framework

Private healthcare in Tasmania

Tasmania operates the Child and Youth Safe Organisations Framework, which includes a reportable conduct scheme. Whether and how it applies to a particular private healthcare service should be confirmed with the Office of the Independent Regulator.

Who is legally required to comply?

  • Private hospitals, approved Mental Health Act facilities and counselling services are among the health categories required to comply with both the Standards and Reportable Conduct Scheme, subject to the OIR scope guidance.
  • Other child-serving health services, including general practices, allied health services and licensed day-procedure centres, can be required to comply with the Child and Youth Safe Standards without being covered by the Reportable Conduct Scheme.
  • Apply the OIR test for services specifically for children or supervised facilities for children; infrequent services can still count. Assess each part of a mixed-service organisation.

Local responsibilities

  • Where captured: child and youth safe standards, reportable conduct notification and response
  • Clear internal accountability for the head of the organisation

Record the outcome of your scope check with the OIR as governance evidence.

What must you do legally—and what should you review yearly?

There is no single Australia-wide rule requiring every private healthcare business to buy yearly reportable-conduct training or an annual external audit. Legal coverage depends on the entity, services, jurisdiction and applicable conditions. Child-protection reporting, worker screening, professional regulation and licensing duties may still apply even where a reportable conduct scheme does not.

Legal responsibilities: where covered, implement the applicable child-safe standards, maintain prevention and response systems, train and support workers as required, and make reports and investigate within local requirements. An annual review must never delay a notification or immediate safety response. A completion certificate does not discharge these duties.

Our recommended yearly programme: refresh role-specific knowledge, test reporting pathways, review policies and training records, sample evidence lawfully, and give the board an action register and progress report. Review sooner after an incident, a legal change or a significant service change. New starters need induction, not a wait until the next annual session.

Check your own requirements: licensing conditions, accreditation standards, contracts or regulator directions may impose additional training, assessment or review obligations and frequencies. Record the actual requirement and source for each facility; do not treat this commercial programme as a substitute.

  • Board / governing body: review risk, completion gaps, control-testing results and overdue corrective actions; require evidence from management.
  • Accountable head / executives: own the applicable statutory reporting obligations, resources, delegations and investigation arrangements; confirm that remediation is completed.
  • Managers / clinical leaders: practise receiving concerns, protecting children, escalating promptly and preserving records.
  • Frontline employees, contractors and volunteers: complete relevant induction and refreshers, recognise boundary breaches and know internal and external reporting routes. Individual reporting duties are not replaced by telling a manager.

Use the state-specific regulator sources above to confirm coverage. Obtain independent legal advice where your service’s status or a reporting duty is uncertain.
